Delaware’s General Assembly passed the Delaware Gaming Competitiveness Act of 2012, becoming the second state to legalize online casinos and poker rooms. At the time, Gov. Jack Markell vowed Delaware would be the first state to launch legal online gambling.

Formally called the Multi-State Internet Gambling Association (MSIGA), the compact allows poker sites in both states to share players (“shared liquidity”). January 15, 2019 | US Department of Justice Reverses Opinion on Online Gambling

Acting US Attorney General Matthew Whittaker announced the U.S. Department of Justice was reversing its opinion on online gambling. Starting in 90 days (later extended to June 14, 2019), the DOJ would view all interstate online gambling as illegal. From 2011 to 2019, the DOJ viewed online casinos and poker sites as legal (if states legalized them), while online sportsbooks were illegal under terms of the 1961 Wire Act. The new interpretation states the Wire Act bans all forms of internet gambling.

June 3, 2019 | US District Judge Rejects US DOJ’s New Opinion

US District Judge Paul Barbadoro rejected the Department of Justice’s new opinion on the online poker and casino sites. In March 2019, the New Hampshire Lottery sued the DOJ, stating it had no right to ban online lottery ticket sales. New Jersey later joined the lawsuit to protect its online poker and casino industry. Judge Barbadoro stated in his opinion, “I hereby declare that § 1084(a) of the Wire Act…applies only to transmissions related to bets or wagers on a sporting event or contest. The 2018 OLC Opinion is set aside.”

From 2013 to early 2019, Delaware’s online casinos and poker rooms operated without interference from federal authorities. The biggest concern was the state’s small population and driving more players to its online gaming sites — especially the poker rooms. Then in January 2019, the US Justice Department reversed its longstanding opinion on interstate online poker and casinos.

Soon after, the New Hampshire State Lottery sued the DOJ over its opinion, because the ban could affect online lottery ticket sales. A month later, New Jersey joined the lawsuit, due to its concerns about the New Jersey’s lucrative online betting industry. In early June, US District Judge Paul Barbardoro rejected the January 2019 DOJ opinion. For now, online casinos and poker sites are legal and licensed in Delaware.
